1. Who we are and what this notice regulates

Ertler Executive Search is a personnel consultancy specialized in executive search. We assist companies in filling leadership positions at the C-level and department head level. This data protection notice describes how we process personal data of candidates, regardless of whether you have actively approached us, have been contacted by us, or have been recommended to us by third parties.

2. What personal data we process

Depending on the nature and scope of our collaboration, we process the following categories of candidate information:

• Contact details, such as name, address, phone, and email
• Biographical data and professional background
• Educational qualifications, certificates, and qualifications
• Information from conversations, interviews, and assessment procedures
• Suitability assessments and competency evaluations
• Professionally relevant publicly available information, such as LinkedIn or publications
• Information from third parties, especially from references you provide to us

We ask you not to provide us with information that is not necessary for our services. We only process special categories of personal data if you explicitly provide them to us with your explicit consent.

3. Purposes and legal bases of processing

We process your candidate information based on our legitimate interests according to Art. 6 para. 1 lit. f GDPR and, where necessary, based on your consent according to Art. 6 para. 1 lit. a GDPR.

• Conducting executive search mandates and suitability assessments for specific positions
• Operation and maintenance of our internal candidate database
• Analysis and matching of candidate profiles with the requirements of our clients
• Contacting potentially suitable career opportunities
• Fulfillment of our obligations to clients in connection with conducted mandates

4. Disclosure of candidate information

As part of our mandates, we may share selected excerpts of your candidate information, particularly your professional background and relevant qualifications, with client companies to assess whether there is general interest in your application. The scope of this information is limited to what is necessary for this purpose.

A complete presentation of your person to a client company occurs after we have informed you about the respective company and the context of the mandate. You grant your consent for the presentation to client companies by agreeing to this privacy notice. You can revoke this consent at any time.

Your candidate information is accessible to the consultants of Ertler Executive Search through our internal database, as far as necessary for the provision of our services. We also employ carefully selected service providers who act as processors in accordance with Art. 28 GDPR.

5. Use of AI Support

We use Claude from Anthropic as part of a commercial Teams subscription. AI functions assist our consultants in internal work, such as conversation preparation, research, and summaries. All assessments of your suitability are made solely by our team. An automated individual decision within the meaning of Art. 22 GDPR does not take place.

6. Data Security and International Transfers

We take technical and organizational measures in accordance with the state of the art to protect your data. To the extent that service providers process data outside the European Economic Area, we ensure an adequate level of protection through appropriate guarantees in accordance with Art. 46 GDPR, in particular EU standard contractual clauses.

7. Storage of Your Data

We store your personal data as long as there is a legitimate interest or your consent. Your candidate information may also be relevant for ongoing or future business purposes even after the completion of a specific mandate, such as for documenting our business activities, safeguarding legal claims, fulfilling our obligations to clients, or considering you for future mandates.

8. Your Rights

In accordance with applicable data protection laws, you have the following rights:

• Access to the data stored about you
• Correction of inaccurate or incomplete data
• Deletion of your data, provided there is no legal basis for further processing
• Restriction of processing under certain conditions
• Objection to processing based on our legitimate interests
• Data portability, provided the processing is based on consent or contract
• Withdrawal of consent granted at any time with effect for the future

For candidates residing in Austria: Austrian Data Protection Authority, Barichgasse 40–42, 1030 Vienna.

9. Changes to this Privacy Notice

We reserve the right to adjust this privacy notice in case of changes to our processes or the legal situation. The current version is available on our website.
