Ertler Executive Search ist eine auf Executive Search spezialisierte Personalberatung. Wir unterstützen Unternehmen bei der Besetzung von Führungspositionen auf C-Level und Bereichsleiterebene. Dieser Datenschutzhinweis beschreibt, wie wir personenbezogene Daten von Kandidatinnen und Kandidaten verarbeiten – unabhängig davon, ob Sie aktiv auf uns zugekommen sind, von uns angesprochen wurden oder uns von Dritten empfohlen wurden.

2. Which personal data we process
Depending on the nature and scope of our collaboration, we process the following categories of candidate information:
Contact details (name, address, phone, email)
Biographical data and professional background
Educational qualifications, certificates, and qualifications
Information from conversations, interviews, and assessment procedures
Suitability assessments and competency evaluations
Professionally relevant publicly available information (e.g., LinkedIn, publications)
Information from third parties, especially from referees you name to us
We ask you not to provide us with information that is not necessary for our services. We only process special categories of personal data (e.g., health data, political or religious beliefs) if you explicitly provide this information to us with your explicit consent.
3. Purposes and legal bases of processing
We process your candidate information based on our legitimate interests (Art. 6 para. 1 lit. f GDPR) and, where necessary, based on your consent (Art. 6 para. 1 lit. a GDPR) for the following purposes:
Conducting executive search mandates and suitability assessments for specific positions
Operation and maintenance of our internal candidate database
Analysis and comparison of candidate profiles with the requirements of our clients
Contacting potentially suitable career opportunities
Fulfillment of our obligations to clients in connection with conducted mandates
Our legitimate interests consist in providing you with suitable leadership positions and supporting our clients with qualified candidates. These interests generally outweigh your opposing interests, as the processing is limited to your professional career and no impairment of your fundamental rights and freedoms is to be expected.
4. Disclosure of candidate information
4.1 Client companies
As part of our mandates, we may share selected excerpts of your candidate information – particularly your professional career and relevant qualifications – with client companies to check whether there is a fundamental interest in your candidacy. The scope of this information is limited to what is necessary for this purpose.
A complete presentation of your person to a client company takes place after we have informed you about the respective company and the context of the mandate. You give your consent for the presentation to client companies by agreeing to this privacy notice (see section 10). You can revoke this consent at any time – even for a specific client company.
4.2 Internal disclosure
Your candidate information is accessible to the consultants of Ertler Executive Search through our internal database, as far as this is necessary for the provision of our services.
4.3 Service providers
We use carefully selected service providers who act as processors in accordance with Art. 28 GDPR (in particular, providers of our candidate management system and AI-supported work tools). They are contractually obliged to process your data solely in accordance with our instructions and with appropriate protective measures.
4.4 Other Disclosure
Any further disclosure of your data to third parties only occurs if we are legally obliged to do so or you have expressly consented.
5. Use of AI Support
We use Claude (Anthropic) as part of a commercial Teams plan. Anthropic contractually guarantees that data from commercial plans will not be used for training or improving AI models – unless the customer expressly opts in. This is bindingly stated in Anthropics Commercial Terms.
AI functions assist our consultants in internal work (e.g., conversation preparation, research, summaries). All assessments of your suitability are made solely by our team. An automated individual decision within the meaning of Art. 22 GDPR does not take place.
6. Data Security and International Transfers
We implement technical and organizational measures to protect your data that are in line with the state of the art. To the extent that service providers process data outside the European Economic Area, we ensure an adequate level of protection through appropriate guarantees in accordance with Art. 46 GDPR – in particular, EU standard contractual clauses.
7. Storage of Your Data
We store your personal data as long as there is a legitimate interest or your consent. Please note that your candidate information may also be relevant for our ongoing or future business purposes even after the completion of a specific mandate – for example:
for the documentation of our business activities
for the preservation, exercise, or defense of legal claims
to prove the fulfillment of our obligations to clients
to consider you for future mandates that are suitable for you
As far as legal retention obligations oppose deletion, processing will be restricted for the duration of the respective period. You can object to the storage of your data at any time (see section 8).
8. Your rights
In accordance with applicable data protection laws, you have the following rights:
Information about the data stored about you (Art. 15 GDPR)
Correction of inaccurate or incomplete data (Art. 16 GDPR)
Deletion of your data, as long as there is no legal basis for further processing (Art. 17 GDPR)
Restriction of processing under certain conditions (Art. 18 GDPR)
Objection to processing based on our legitimate interests (Art. 21 GDPR)
Data portability, as far as the processing is based on consent or contract (Art. 20 GDPR)
Revocation of granted consent at any time with effect for the future (Art. 7 para. 3 GDPR)

9. Changes to this privacy notice
We reserve the right to adjust this privacy notice in case of changes to our processes or the legal situation. The current version is available on our website. In the event of significant changes affecting your data stored with us, we will actively inform you.
10. Consent declaration (application form)
Below is the wording of the consent declaration that applicants actively confirm when submitting an application via our website:
